Ebay seller never shipped, never received, refund, what feedback?

I bought this item on ebay about more than 1 month ago. I had bought something from this same seller before, and previously the seller will make notification on ebay that the item had been shipped. This time, the seller never did it on ebay but weirdly the seller sent a personal message to my email (not on ebay) 1 WEEK after the payment that the item had been sent. Weird I think. Then after 1 month, I never received the items so I contacted the seller, however, after an excuse or so the seller said that the item cant be tracked and issued me refund. The seller also demanded me 5 stars and positive feedback. The seller hasnt left any feedback yet. I think this seller is lying about ever shipping the item, should I leave this seller a neutral feedback? Any advice would be appreciated
